Sure, when you at the same time set the Overlay flag with the alpha threshold at 50.

Yes, when you don't set the overlay flag.
Setting OVERLAY means that you want alpha to be clipped below the 50% threshold.

but I want it to be overlay and transparent with alpha under 50..if i don't use overly black area is visible..

You can use a TGA-file with alpha-channel (32bit) for the transparent parts.
This way you don't need to use the OVERLAY-flag.
